Lawyer Gawaya Sues Lt. Gen. Muhoozi, CDF Mbaddi & A.G Kiwanuka Over First Son’s Bid For Presidency

By Ivan Mwine

City lawyer Gawaya Tegulle has dragged the Commander of Land Forces (CLF) Lt. Gen. Muhoozi Kainerugaba, the Chief of Defence Forces (CDF) Gen. Wilson Mbadi and  the Attorney General Kiryowa Kiwanuka to court, over allegations that Muhoozi is engaging in political activities yet he is still a serving military officer.

It should be noted that under the Constitution of Uganda and the Uganda Peoples Defence Forces (UPDF) Act a serving military officer is barred from engaging in partisan politics unless he/she first resigns from the army.

However, contrary to the UPDF Act and the Constitution, Muhoozi is engaging in politicking, well-knowing it is against the law, yet the CDF Mabadi and the Attorney General Kiwanuka are just watching without putting him to order.

Court summons issued against Lt. Gen. Muhoozi Kainerugaba, Gen. Wilson Mbadi and Kiryowa Kiwanuka

It is for that reason that Gawaya dragged Muhoozi, Mbadi and Kiwanuka to the Constitutional Court of Uganda vide  Constitution Petition No.10 of 2022.

Lawyer Gawaya Tegulle who petitioned court

The summons issued by the Court Registrar to Muhoozi, Mbadi and Kiwanuka reads in part thus;

“Take notice that Gawaya Tegule has filed a petition against you in this court.

Should you fail to file an answer on or before the date mentioned, the petitioner may proceed with the petition which may be determined in your absence.

Given under my hand and seal of this Honourable Court   this 6th day of May 2022.”

However, neither Kiwanuka, Mbadi nor Muhoozi has since submitted their response to the court summons.

It should be noted that Muhoozi  a few days ago launched his bid for the presidency under what is known as  ‘Muhoozi Project’, which kicked off with a national celebration of his 48th birthday.
